Important Information for Lawful Permanent Residents Traveling Abroad

Lawful Permanent Residents (LPRs), often known as Green Card holders, are subject to inspection by U.S. Customs and Border Protection (CBP) each time they reenter the United States. While LPRs generally enjoy more rights than nonimmigrants, recent enforcement changes have resulted in increased scrutiny at ports of entry—especially for those who have been outside the country for an extended time, have prior immigration violations, or a criminal history.

When returning, CBP officers will determine whether you qualify as a “returning resident” or are considered an “arriving alien.” If you’re classified as an “arriving alien,” you could be sent to secondary inspection. This process may include extended questioning and even searches of your personal electronic devices.

Never sign Form I-407, which is used to voluntarily give up your LPR status, without first speaking to an experienced NYC immigration attorney. Only an immigration judge can officially determine whether you’ve abandoned your status.

If you’re detained, know your rights:

  • You have the right to contact your consulate
  • You have the right to speak with an attorney
  • You have the right to remain silent
  • You have the right to review all documents in a language you understand

And importantly, you are entitled to a hearing before an immigration judge if CBP challenges your admissibility. DO NOT waive this right. Additionally, you are not required to answer questions about your political beliefs or activism.
