What To Do if an Immigration Agent Arrives at Your Door
Many are unsure what to do when an immigration lawyer shows up at their door. Considering the stakes of the situation, you will probably want to be as cooperative as possible to avoid potential issues, and you can do so while still invoking your rights. Try to remember to take the following steps if an immigration agent comes to your door:
- Do not open the door. This is your right. Immigration agents can only enter your home if they have a warrant signed by a judge, which they should be able to present to you. Often, when immigration agents come to your door, they do not have a warrant and therefore have no legal right to entry. It is important that you do your best to remain calm in this situation and remember your rights .
- If the agent has a warrant, ask them to slip it under the door so that you can check to see if it has been signed by a judge. It is vital that you ensure it is signed by a judge, as many “warrants” are not. During this time, you also do not have to answer any questions asked by the agent.
- If an agent pushes their way into your home, it is important that you verbally and explicitly declare that you do not consent to them being in your home and you do not consent to a search of your home. This may not get them to leave but it can help any future legal case you may wish to pursue or become a part of.
- Make sure no one in your home undergoes a search or answers questions, as they are not required to. You have the legal right to remain silent. You may also want to memorize an emergency contact number in the rare event that you become detained. You should also inform the agent if there are any children or other vulnerable residents inside the home.
Your Rights When Dealing With ICE
If an ICE agent stops you anywhere, you can ask them if you are free to go. If they say yes, you can inform them you do not wish to answer any of their questions. If they say no, you can say that you wish to remain silent. If they try to search your person, such as any bags or your pockets, you can tell them you do not consent to being searched. No matter your immigration status, these are your legal rights.
