- Eligibility — Unmarried individuals under the age of 21 can seek the protection afforded by SIJS and potentially remain in the United States if living with their parents presents a danger. Our firm can go over the eligibility requirements and prepare Form I-360 if you qualify.
- Dependency — It’s important to remember that SIJS is limited to situations where a U.S. juvenile court with appropriate jurisdiction has made a finding of dependency. Applications cannot be based on mere assertions or ruling from foreign authorities. We can seek relief if a juvenile court has held that the subject of the proceeding is eligible for long-term foster care and that it would not be in the undocumented youth’s best interests to be returned to his or her parents.
- Adjustment in status — Should the required conditions be met, our firm advocates for clients pursuing an adjustment in their status by applying for lawful permanent residency under Form I-485. During this period, the subject of the proceeding is able to work legally in the United States if they are old enough. As long as the applicant files for SIJS protection before turning 21, he or she can obtain a green card even if they are older by the time the matter is resolved.
